What Is a Spill? 

A spill is a discharge of any oil or hazardous material into the environment. 

Per Oregon Department of Environmental Quality (ODEQ);
Reportable  spill or release include:
  • Any amount of oil to waters of the state;
  • Oil spills on land in excess of 42 gallons;
  • Hazardous materials and reportable quantities that are equal to the Code of Federal Regulations 40 CFR Part 302.
It is important to remember that even if the amount of material spilled is below the reportable quantity, cleanup is required.

Some spills will require separate notification to National Response Center per EPA's Emergency Response.

The responsibility of the spill cleanup lies with the person who spills the product, as well as the person owning or having authority over the oil or hazardous material.

An Ounce of Prevention

FSE offers its clients a "FSE Spill Response Service Agreement" which is a proactive way to avoid costly delays when catastrophes occur. When spill emergencies happen, the response team is immediately dispatched to the site. The client signed FSE Spill Response Service Agreement will often satisfy the regulatory requirements to maintain a contractual relationship with a qualified emergency response company.

Since spills don’t always happen during convenient times, our FSE Spill Response Service Agreement" assures that you are able to immediately show regulatory agencies that you are meeting Agency & Regulatory requirements for your responsibilities to immediately clean up your spill regardless of the quantity involved. 

Our clients only have to call FSE in an emergency and we, as your Emergency Spill Response Contractor can respond immediately. When moments count, having FSE's information ready to share with your incidents Regulatory Agencies as your qualified contractor can show you are taking that responsibility for immediate response to cleanup your spill/release.  It is important to know that if you fail to clean up your spill, DEQ may clean it up for you, as allowed by law, fine you up to three times the cost of the cleanup, in additional to the actual cost of the cleanup (Oregon Administrative Rules 340-142).
